Background on the SPCC Plan
On July 17, 2002, the EPA published a final rule amending the Oil Pollution Prevention regulation (40 CFR Part 112) promulgated under the authority of the Clean Water Act. This rule included requirements for Spill Prevention, Control, and Countermeasure (SPCC) Plans, and for Facility Response Plans (FRPs). It also included new subparts that outlined the requirements for various classes of oil, revised the applicability of the regulation, amended the requirements for completing SPCC Plans, and made other modifications. On February 17, 2006, the United States Environmental Protection Agency extended both the Plan Amendment and Implementation dates to October 31, 2007 to all regulated facilities. The rule was further amended in December 2008 and November 2009. The November 2009 amendments revise the December 2008 amendments as a result of EPA's review of comments and consideration of all relevant facts. Apart from some minor technical corrections, EPA left the majority of the December 2008 provisions intact. However, the 2009 amendments did modify the December 2008 rule by removing the provisions to: exclude farms and oil production facilities from the loading/unloading rack requirements; exempt produced water containers at an oil production facility; and provide alternative qualified facilities eligibility criteria for an oil production facility.
