Administration Belatedly Publishes 2012 “Current Regulatory Plan and the Unified Agenda of Regulatory and Deregulatory Actions”

The Obama Administration finally published its 2012 regulatory agenda today.  EPA’s compilation of rules at various stages of development in the rulemaking process include several of possible interest to members of the chemical industry, including but not limited to:

  • Electronic Reporting of Toxics Release Inventory Data Under the Emergency Planning and Community Right-to-Know Act (EPCRA) Section 313  -- a final rule is expected by August , 2013;
  • Management Standards for Hazardous Waste Pharmaceuticals – a second Notice of Proposed Rulemaking is expected by August, 2013;
  • Addition of Subsurface Component to the Hazard Ranking System (HRS) – a Notice of Proposed Rulemaking is expected by May, 2013;
  • The Definition of Solid Waste rule – a final rule is now expected by April, 2013;
  • New Source Performance Standards (NSPS) Review – a Notice of Proposed Rulemaking is expected by September, 2013;
  • Compliance and Emissions Data Reporting Rule – A Notice of Proposed Rulemaking is expected by May, 2013;
  • National Emission Standards for Hazardous Air Pollutants: Startup, Shutdown, and Malfunction Amendments to Part 63 Standards – A Notice of Proposed Rulemaking is expected by February, 2013
